Your Closing Appointment
This is the day that everything agreed to in the contract must be completed. When all of the contract requirements have been fulfilled and the deed has been recorded, the ownership of a house may be transfer from the seller to you.
Closings in North Carolina are usually held in the office of the buyer's Closing Attorney.
Who is there?
The following people are often at a closing: The Buyer, the Seller , Raleigh Real Estate Agents for both Buyer and Seller, Buyer's Lender representative, and the Raleigh Closing attorney - usually the buyer's attorney.
What Goes on - Who Does What?
The closing attorney has figured out who owes who, including taxes, title searches, home warranty, inspections, HOA dues, etc. All
this is on the HUD-1 (settlement statement).
The HUD-1 is the first thing to be reviewed. The attorney goes over this with everyone. All parties involved and the real estate agents review the HUD-1 and must agree on its accuracy.
Then the signing begins. The buyer and seller will first sign the HUD-1. Then all the remaining documents will be reviewed and signed. There are lots of them and they are all important. The closing attorney usually explains them as he or she goes.
The sellers will usually sign their paperwork first and leave. The documents regarding your loan and down payment are personal and confidential and are not review until the seller has left.
When do I get the Key to my New Home?
The title to the property must be transferred from the seller to the buyer for the home to be YOUR home - and therefore be entitled to the
key. Several steps must occur for this to happen.
The monies involved in the transaction must be delivered - usually a funds transfer is provided by the buyer's lender.
The deed must be delivered to you, the buyer, and you must accept it. A deed is the document that transfers ownership of real estate from one person to another. "Delivering the deed" means that the attorney hands it to you and asks you if you accept it.
The deed must be recorded at the courthouse and all money sent to all the appropriate parties.
Once all this has been completed you will receive the keys to your new home! This may occurs the day of or the day after closing.
